Information on processing of personal data pursuant to art. 13 D. Decree 30 June 2003, n. 196 (relating to the protection of personal data – the “Code”)
Before accessing and using PubCoder you need to read the Information on the processing of personal data made by PubCoder, which is provided to help all users to consciously decide whether to begin to use or continue to use PubCoder and to describe how PubCoder treats personal data information of its users.
When you register and create your account, you – as the Registered User – agree to the PubCoder Terms of Service and Use and confirm that you have read the information on the processing of personal data, as well as give your consent to the processing of personal data as described below, and always in accordance with Italian law. This Policy only concerns the PubCoder Site and it is otherwise not applicable.
The Data Controller is PubCoder Srl, based in Via Cavour 11, Turin (Italy). PubCoder will have the power to appoint “an independent data controller of the processing” of data relating to credit cards and alternative forms of payment chosen by the Registered User who buys Licenses, companies appointed by PubCoder for the management of payments, as well as companies that provide services to Users of PubCoder by registering in Single Sign On.
How PubCoder collects personal data of its Users
1) Personal data collected by the User and personal data collected by Facebook and Twitter.
In order to access and to use PubCoder you need to create an account directly through the PubCoder website or, eventually, through Facebook and/or Twitter connect and/or Linkedin (hereinafter “Social Network”). To use the “FAQ” function in the public site and “Help” function in the private area of PubCoder a single sign on (SSO) is used, that transfers account data to Responsa Srl.
For this purpose, PubCoder requires consent to the collection and processing of certain personal data, that is the e-mail address, the name and surname, and other personal data that the User may have chosen to make accessible to anyone based on the privacy settings of a Social Network’s profile, if the User should decide to use a Social Network processing the PubCoder registration. These data may include, in particular, the username and the e-mail address provided when creating the account on the PubCoder website or through a Social Network.
PubCoder can collect data for billing and Registered User’s transaction data in the event of the accession to Purchase Proposal. Such data may include information to process payments and billings of the Registered User.
PubCoder will not collect/treat other personal data in addition to those mentioned above. In particular PubCoder will not archive on its servers data related to credit cards or alternative forms of payment chosen by the Registered User who agreed a Purchase Proposal.
The data relating to credit cards or alternative forms of payment will be collected and processed by companies appointed by PubCoder for the management of payments.
2) Other personal data.
PubCoder provides to Users a request/response service edited by the Users: PubCoder Users post questions and other PubCoder Users’ post the answers.
What User writes and shares in the PubCoder site may contain his and third parties personal data. These data will be accessible (and, consequently, at least potentially usable) to other PubCoder Users: this could happen for every User or for just some of them, depending on the privacy settings of the account, that each user is required to carefully check immediately after the registration on the site or otherwise, at the latest, before posting anything on PubCoder, to avoid an undesirable circulation of the data.
Moreover, the sharing of personal data of other persons on the PubCoder site assumes that Users who publish such data have complied with the Italian legislation and, in particular, have informed the interested parties pursuant to art. 13 of the Code and have collected their consent to process personal data, just like what is now making PubCoder.
PubCoder doesn’t collect or process personal data that could be contained in the questions and/or answers posted by users and is not responsible for their protection, nor for the use that other PubCoder Users can make of such data, to whom the personal data have been made available to those who have shared them. PubCoder is not also responsible for any unlawful treatment, made by its Users, of other users and/or third parties’ personal data.
When users visit PubCoder website, one or more cookies can be sent to their computers – a cookie is a small text file containing a string of alphanumeric characters that uniquely identifies the browser.
PubCoder uses both session cookies and persistent cookies: a persistent cookie survives the browser closing and can be reused during next sessions unless it has been previously removed (to remove persistent cookies it is necessary to follow the instructions of the web browser); the session cookies are temporary and disappear after you close the browser.
You can reset your web browser to refuse all cookies or to require a notify in the case of transmission of a cookie; but, in case the user chooses to disable the receipt of cookies, PubCoder may not function properly.
Personal data collected by PubCoder using cookies, whether they are persistent or session, will be collected and processed exclusively in anonymous and aggregate form and, consequently, they will be not attributable to any of PubCoder Users or even less, it won’t be possible to go back to Pubcoder Users identities through them.
In the context of access to the Pubcoder site, PubCoder servers automatically record information that the browser automatically sends whenever you visit a website: they are the Log files.
The Log files may contain certain information, such as: web request, Internet Protocol (“IP”) address, browser type, browser language, referring/output pages and URLs, platform type, number of clicks, domain names, landing pages, pages viewed and the order of those pages, the amount of time spent on each page, the date and time of the request, one or more cookies, etc.
Personal data collected by PubCoder through log files will be collected and processed exclusively in anonymous and aggregate form and, consequently, they will be not attributable to any of the Users of PubCoder, or it will be not possible to trace the identity of Users through them.
PubCoder may also use the so called “Clear GIFs” (or Web Beacons), generally used to obtain information on the use and frequency of use of the site PubCoder by Users, and transparent GIF in the e-mail based on HTML sent to Users to verify which e-mails are opened by recipients.
Any personal data collected by PubCoder using GIFs will be collected and processed exclusively in anonymous and aggregate form and, consequently, they will be not attributable to any of the PubCoder Users, or it will be not possible to trace the identity of the PubCoder Users through them.
On the occasion of the first access to the PubCoder site and before creating your account, clicking on the “Accept” button, the user gives consent to process the personal data collected by PubCoder for the registration of the account and, in general, the use of PubCoder site (including technical assistance, management of complaints about the offered service and the users satisfaction survey).
The conferral of user personal data for the above purpose is optional, but a refusal will preclude the possibility to use the PubCoder site and all its features.
The personal information of each User will be stored and processed by computerized procedures in secure servers and databases owned by Amazon Web Services Inc. (aws.amazon.com/privacy/).
For safety reasons, a data backup will be made periodically. PubCoder assumes, in respect of Users, the commitment to take all necessary measures for the security of the collected personal data and also because the processing of personal data could be carried out in full compliance with Italian law.
Each PubCoder account is protected thanks to the password of the account on PubCoder site or Social Newtork accounts for each User. PubCoder Users are the only responsible for the security of the password: PubCoder recommends its Users to take care to keep it secret and strictly private.
Data Communication and dissemination
The personal data processed by PubCoder will be made available only to persons who PubCoder will appoint as Officers and/or Responsible for the data process. In particular PubCoder appoints external Managers those persons who will install a software and/or its Updates available on PubCoder, and will be appointed external Managers those active Users who also create content using the Software.
The personal data processed by PubCoder may be communicated to the following categories of persons:
– Other companies controlled by, controllers or put under common control with PubCoder or linked to them;
– Service providers necessary for the provision of services or data processing specifically identified and authorized by PubCoder;
– Others with whom PubCoder has entered from time to time into cooperation agreements related to the site or the provision of services which are subjects of the site.
PubCoder will not divulge personal data to any user.
PubCoder recommends all its Users to carefully check the privacy settings of their account immediately after registering to the site and otherwise, at the latest, before posting anything on PubCoder, to avoid the circulation of personal data that you do not want to make accessible.
The personal data collected by PubCoder will be not divulged.
Each User of the PubCoder site owns the rights under Art. 7 of the Code, in other words: the holder has to confirm the existence or not of his personal data and their provision in an intelligible form, the identity of the owner and of the persons whom data may be communicate; the User has to obtain the update, rectification and integration of data, deletion, transformation into anonymous form or blocking of data processed in violation of the law, and he/she can oppose, for legitimate reasons, to the processing of data. PubCoder Users may exercise their rights as described above at any time, writing to email@example.com
At the same e-mail address it will be also possible to submit requests for clarification regarding the processing of personal data or to this Policy, besides any requests for deletion of personal data.
In the event that a User decides to cancel his PubCoder account, PubCoder will erase all personal data from its database and his/her profile will be no longer visible to other users; nevertheless, remain traces of its profile in the activities history realized on PubCoder until the time of cancellation of the profile.
This Policy on the processing of personal data can be modified and/or updated over time.
PubCoder will promptly inform its Users when significant changes are made to this Policy by e-mail; anyway PubCoder Users have to periodically check the contents of the Policy, available at internet address http://pubcoder.com/privacy-policy.
